Our Privacy Commitment
This policy answers the following questions:

What information do we collect about you and how do we use it?
Types of Identifying Information We Collect
Personal information means information that can be used to identify and contact you. You do not need to submit personal information to access the SPOT Features generally. However, you may be required to submit personal information to access certain aspects of the Site, the App, and the SPOT Features. We may collect non-personal information, such as your browser type, when you accessed the SPOT Features and from what physical location you accessed the SPOT Features. This information may be aggregated to measure the number of visits, average time spent, page views, and other statistics about users of the SPOT Features. We also may use this data to monitor the SPOT Features’ performance and to make the SPOT Features easier and more convenient to use.
We collect personal information when you create an account through the SPOT Features; participate in registration forms, feedback forms or surveys; or receive customer or technical support.
To create an account for the SPOT Features, we require you to provide certain information to create your profile, including your name, email address, phone number, username, and password. Providing additional information beyond what is required to create an account, including your age, gender, marital status, birthdate, a profile photo, and an event description is optional, but enables you to gain more from the SPOT Features. Your name, age, gender, profile photo, and event description will be used to identify you publicly to other users on the Site, in the App, and through the SPOT Features.
We also offer features of the Site that allow you to link your account to Facebook and Google, and other social medial networks. If you sign up for one of those features, we may also collect personal information from these services.
By submitting personal information through the Site, you authorize SPOT to share this personal information for the purposes identified herein and in providing the SPOT Features, such as responding to user inquiries, distributing materials, and requesting feedback.
Types of Non-Identifying Information We Collect
We may also collect general information resulting from your activity on the Site or in the App, including your preferences and other tendencies. This may include anonymous “traffic data” or tracking information provided by the website’s host or similar provider of such information (i.e., Google Analytics) that does not personally identify you, but may be helpful for marketing purposes or for improving the services we offer. Analytics is the process of collecting, analyzing, and reporting aggregate data. This information may include which pages visitors visit, how long visitors may stay on a particular page, and where visitors are located. It may also provide information about what browser, network, or device is used to visit our Service. In addition, when you visit the Site, we may also log your anonymous IP addresses, a unique identifier for your computer or other access device. This helps us diagnose problems with our server, to administer the SPOT Features, or to display the content according to your preferences.
Third Party Services
For your convenience, we may link to third party sites and services, or otherwise display third party content through the Site or the App. Here are some examples of third-party content and services available through or via the SPOT Features:
- YouTube– We may embed content on the Site or in the App from other online services, such as a recorded video.
- Infrastructure – We use Amazon Web Services to support the Site, the App and infrastructure.
Please note that these other sites may send their own cookies to users, collect data, or solicit personal information. We urge you to review the data protection, privacy, and cookie policies available on their websites. We do not accept any responsibility or liability for the data protection of privacy practices of third parties in relation to such websites and your use of third-party websites is entirely at your own risk.
How We Use Your Personal Information
We may use your personal information with non-personal information that we have collected in a manner such that the end-product does not personally identify you or any other user of the SPOT Features. We may make your personal information non-personally identifiable by either combining it with information about other users (aggregating your personal information with information about other users), or by removing characteristics (such as your name or email address) that make the information personally identifiable. This process is known as de-personalizing your information. You grant us a royalty-free, worldwide, perpetual, irrevocable and fully transferable right and license to use your personal information in connection with the creation and development of analytical and statistical analysis tools relating to the use of the customer data we collect in providing the SPOT Features (the “Analytical Data”). We are expressly authorized to make any commercial use of the Analytical Data including, without limitation, sharing the Analytical Data with third parties, provided that we do not sell, trade, or otherwise transfer from us any part of the Analytical Data that personally identifies any SPOT Features users.
Do Not Track
In compliance with California legislation, AB370, effective January 1, 2014, SPOT’s practices in responding to “do not track” signals and collecting user information over time and across a network of websites when you visit the Site are as follows: We honor the request of “do not track” signals sent by your browser when you visit the Site. Additionally, SPOT does not collect user information about your online activities over time and across different websites, or authorize third parties to do so.
We receive location information when you are using the SPOT Features, which may include when the App is in use in the foreground or background. We may continuously collect location information and other motion-generated or orientation-generated mobile sensor data from you when the SPOT Features are in use in the foreground or background in order to personalize the user experience, assist in finding nearby events, or other seminal purposes. We also may use this information for analytics purposes. You may have the ability to turn location-based services on and off by adjusting the settings of your Internet browser or mobile device or, for some devices, by revoking permission for our mobile apps to access your location information.
Our servers automatically record information that your browser sends whenever you visit the Site. This information includes your Internet Protocol address, your browser type and version, the search engine you used to find the SPOT Features, if any, which SPOT Features you use and from where, and when and how long you use them. We use this information to monitor and analyze how users use the SPOT Features, to provide customer service and to maintain and improve the SPOT Features. This information allows for more accurate reporting and improvement of the SPOT Features.
We do not knowingly collect personal information from children under 13, or allow them to create an account for the SPOT Features. We take children’s privacy seriously and encourage parents to play an active role in their children’s online experience at all times.
Will we share your personal information with third parties?
Sharing Your Information
- Asset transfers. If we become involved in a merger, acquisition or other transaction involving the sale of some or all of SPOT’s assets, user information, including personal information collected from you through your use of the SPOT Features, could be included in the transferred assets. Should such an event occur, we will use reasonable means to notify you through email and/or a prominent notice in the App and/or on the Site.
Additional Information You Should Know About Third Parties
Disclosure of Your Information for Security Purposes
SPOT fully cooperates with law enforcement agencies in identifying those who use our services for illegal activities. We will release personal or general information without your consent for security purposes, when required by law, or to prevent imminent harm to any person or entity. We will disclose personal or general information upon receipt of a court order or subpoena, or to cooperate with a law enforcement investigation, which may include responding to requests and court orders from jurisdictions outside the United States. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful, as determined in our sole discretion. If we receive such a request we may, but are not required to, notify you of such request and give you an opportunity to respond.
What choices do you have about the collection and use of your personal information?
Control of Your Information
You may update or delete your personal information or modify your account preferences for the SPOT Features by accessing the account interface provided through the SPOT Features. Please note that if you disable your account, we will keep your contact information on file, and may retain other account information for a reasonable period of time afterward for the purpose of internal account management and fraud prevention activities.
Opting Out of Receiving Communications From Us
If you no longer want to receive our newsletter, emails or other announcements, you may unsubscribe by writing to us at feedback@SPOTapp.io. Please note that you cannot unsubscribe from certain correspondence from us.
What security measures do we take to safeguard your personal information?
The personal information that you provide to us is stored on servers, which are located in secured facilities with restricted access, and protected by protocols and procedures designed to ensure the security of such information. In addition, we restrict access to personal information to SPOT employees, independent contractors and agents who need to know this information in order to develop, operate and maintain the SPOT Features. However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to us or through the use of any of the SPOT Features and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk. Once we receive a transmission from you, we will endeavor to maintain its security on our systems.
In the event that personal information you provide to us is compromised as a result of a breach of security, when appropriate we will take reasonable steps to investigate the situation, notify you and take the necessary steps to comply with any applicable laws and regulations.
What Governing Law Applies?
This notice and our privacy practices will be subject exclusively to the laws of the State of California within the United States of America. By using the SPOT Features, you hereby irrevocably submit to the exclusive jurisdiction of the competent courts of California any claim or matter arising under or in connection with the SPOT Features.
What if I live outside of the United States?
The SPOT Features are hosted and operated entirely in the United States and is subject to United States law. Please do not provide us with any information or attempt to purchase our products if you live outside of the United States. If you are from a jurisdiction outside of the United States, please notify us so that we may take necessary action. This may include terminating your account and deleting your information. We are committed to resolving those issues, so if you have any questions about how we collect or use your information you may email us feedback@SPOTapp.io.
California Residents Privacy Rights
The California Consumer Privacy Act of 2018 (the “CCPA”) is a California law that gives California residents (“consumers”), the right to learn about and control certain aspects of how a business handles the personal information that a business collects about them. Pursuant to the CCPA, effective January 1, 2020, consumers whose personal information have been collected by us, have certain rights, including:
- The right to know the categories of personal information we’ve collected and the categories of sources from which we got the information;
- The right to know the business purposes for sharing personal information;
- The right to know the categories of third parties with whom we’ve shared personal information; and
- The right to access the specific pieces of personal information we’ve collected; and
- The right to delete your information.
California residents also have the right to not be discriminated against if they choose to exercise their privacy rights.
